What Is A No Win No Fee?

On this page we answer questions about No Win No Fee agreements (Conditional Fee Agreement).
A No Win No Fee agreement with your solicitor is often available for many personal injury cases, otherwise known as a Conditional Fee Agreement. A no win no fee agreement means your solicitor will only be paid if your claim is a success. Your solicitor will normally charge a success fee, in this case. Both basic fee and the success fee are usually paid partly or fully by the losing party in the case, i.e. whoever you are claiming against.

Are There Other Costs?

There may be other costs incurred, like court costs or costs involving the compilation of reports, experts and other investigations into your case, but often these will be paid by the losing party also. Such fees paid out to third parties like this are also known as disbursements. Your solicitor should fully explain the nature of any agreement and its fees, including a no win no fee, that you enter into.

Will I End Up Paying Nothing?

You could end up paying fees of the type that the losing party is not ordered to pay up by the courts.
If your claim fails under a no win no fee you will not have to pay your own solicitor but you will still probably have to pay the costs of the successful party – the other side.

Also, you will have to pay any other incurred costs: such as court fees or the fee for medical reports, known as disbursements. However, your solicitor will normally be able to arrange insurance in the event to cover this risk. This is known as after the event insurance and you may have to pay the insurance premium.
